2009 Session Information

Shipping and Acceptance of Dangerous Goods by Road/Rail in Canada, Including Amendment #6

Issues to be addressed include:

• Compliance and safety requirements for handling, offering for transport, and transporting of dangerous goods by road or rail in Canada; and
• Dangerous goods classification, packaging, segregation, labeling, placarding, documentation, and other requirements.

Section 6.1(1) of the TDG (Transportation of Dangerous Goods) Regulation states “A person who handles, offers for transport or transports dangerous goods must:

• be adequately trained and hold a training certificate in accordance with this Part; or
• perform those activities in the presence and under the direct supervision of a person who is adequately trained and who holds a training certificate in accordance with this Part.”

The Occupational Health and Safety Act and Regulations impose a duty on employers to take all reasonable measures to provide for the safety of workers. Numerous court decisions specifically point to the obligation for employers and supervisors to provide adequate training as part of that duty.

Training objectives are to provide:

• an understanding of the fundamental requirements of the TDG legislation; and
• the main foundation for the training required by TDG law to enable an employer to certify a worker as trained to meet TDG requirements

Shippers, Material Handlers, Receivers, Supervisors, Purchasing Staff, Drivers, Managers, and Maintenance, Engineering, Security and Material Control Staff should be trained.
